Terms of Service

Agreement

By accessing or using Mission Winning’s hosted apps, websites, or accounts, you agree to these Terms of Service, the Usage Policy, Supported Regions, Service-Specific Terms, Privacy Policy, and any applicable refund or DMCA notices. If you do not agree, do not use the hosted service. These documents are consumer product terms operated by Mission Winning LLC — not legal advice to you.

Service

Mission Winning provides a free offline workout logger, Mission Coach planning tools, nutrition and other pillar features, education content, optional Super Bundle premium depth, and related websites and apps. The free core logger is offered so you can track training without paywall; premium features may require purchase. We may modify, suspend, or discontinue features with reasonable notice where practicable. Service-Specific Terms apply to Super Bundle, optional AI Coach features, Android distribution, and human coaching interest lists.

Educational only — not medical advice

Mission Winning is educational fitness software, not medical care and not emergency services. Strenuous or max-effort sessions carry extra risk; stopping is always allowed. This app cannot prevent a medical emergency — call local emergency services, not the app. We do not provide medical advice. Pregnancy, miscarriage, and postpartum decisions are clinician-owned.

Accounts & acceptable use

• Provide accurate information; keep your email access secure.
• Do not abuse the service, attempt unauthorized access, or scrape premium content.
• Do not use the app for unlawful purposes.

Premium & refunds

Premium purchases (Super Bundle and related paid features) are subject to checkout terms and our Refunds & cancellation policy. Cancel subscriptions anytime via Profile → Manage billing. Contact support@missionwinning.com for billing issues.

Limitation of liability

To the fullest extent permitted by law, Mission Winning LLC and its suppliers provide the Service “as is” and “as available,” without warranties of any kind, express or implied. We are not liable for personal injury, health outcomes, lost profits, indirect, incidental, special, consequential, or punitive damages, device data loss, third-party outages (including payment or hosting providers), or errors in optional AI outputs. Except for liability that cannot be limited under applicable law, our total liability for all claims arising out of or related to the Service or these Terms in any twelve (12) month period will not exceed the amount you paid to Mission Winning LLC for the hosted service in the twelve (12) months before the claim (or USD $0 if you paid nothing). You assume the risks of physical activity; content is educational, not medical advice.

User content

You may upload or submit content such as meal photos, activity import files, backups, text, or other materials (“User Content”). You retain ownership of your User Content. You grant Mission Winning LLC a worldwide, non-exclusive, royalty-free license to host, process, and display User Content solely to operate and improve the service. You represent that you have all rights needed to submit User Content and that it does not infringe others’ rights or violate law. Do not upload illegal, harmful, or infringing material.

Copyright (DMCA)

If you believe content on Mission Winning infringes your copyright, follow the notice process on our DMCA page. We respond to valid notices under the Digital Millennium Copyright Act. Repeat infringers may have accounts terminated.

Dispute resolution

Except for (a) small-claims court actions and (b) claims for injunctive or other equitable relief to protect intellectual property, any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in the United States. You and Mission Winning LLC waive any right to a jury trial and to participate in a class, collective, or representative action. If the class waiver is found unenforceable as to a particular claim, that claim must proceed in court and not arbitration. You use the hosted service only if you are in a Supported Region. EU and UK consumers: see EU/UK consumers below — the arbitration clause and class waiver do not apply to you.

Changes

We may update these terms. Continued use after changes constitutes acceptance. Material changes will be noted in the app or via email where appropriate.

Acceptable use

You must follow the Usage Policy (Acceptable Use) at /usage. In short: no unlawful use; no unauthorized access; no scraping or redistributing premium content; no CSAM, illegal deepfakes, fraud, harassment, or infrastructure abuse; no presenting Mission Winning as medical diagnosis or emergency care; no abuse of youth/school features. We may suspend or terminate accounts that violate these rules. Report abuse to support@missionwinning.com (subject: AUP abuse).

Eligibility & Supported Regions

You must be able to form a binding contract where you live and meet any age requirements we publish (including parental/guardian consent for youth features). The hosted Mission Winning consumer service is offered only in Supported Regions. We do not support Europe (including France, the EEA, the UK, and Switzerland), Canada, Ukraine, or Organisation of Islamic Cooperation (OIC) member states — see /regions. We do not offer accounts, paid Super Bundle, cloud sync as a supported product, or official support in those places. Signup and checkout are hard-blocked when your connection country matches the block list. If you are in an unsupported region, do not create a hosted account or purchase; self-hosted open-source use is described on /regions and remains your responsibility.

Sanctions, export controls & prohibited persons

You represent that you are not a person or entity designated on any applicable restricted-party, sanctions, or denied-persons list maintained by authorities in jurisdictions where we or our payment, cloud, or distribution partners operate, and that you will not use the Service in any way that would cause Mission Winning LLC or those partners to violate applicable sanctions, export-control, or trade-control laws. We may refuse, suspend, or terminate access where we reasonably believe applicable law forbids providing the Service — including comprehensively restricted jurisdictions and other persons or destinations restricted under applicable sanctions or trade-control programs — even when automated country detection is imperfect. Our commercial Supported Regions exclusions (including Ukraine as a whole) are product-availability rules and are not a claim about any single country’s embargo list. You remain responsible for complying with laws that apply to you.

Service-Specific Terms control over these general Terms only on product-specific points they cover.

Indemnification

You will defend, indemnify, and hold harmless Mission Winning LLC and its officers, members, employees, and agents from and against any third-party claims, damages, losses, and reasonable attorneys fees arising out of or related to: (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms, the Usage Policy, or Supported Regions; (d) your violation of law or third-party rights; or (e) injury or claims arising from your training, nutrition, or other health decisions. This does not require you to indemnify us for our willful misconduct.

Governing law

These Terms and any dispute arising out of them are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Mission Winning is operated by Mission Winning LLC, a Texas limited liability company. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to the arbitration agreement below, exclusive venue for permitted court actions is the state or federal courts located in Texas, United States.

EU/UK consumers

If you use Mission Winning as a consumer habitually resident in the European Union, the United Kingdom, or the EEA: the arbitration clause and class-action waiver above do not apply to you. Nothing in these terms deprives you of the protection of mandatory consumer law of your country of residence, and you may bring proceedings in the courts of that country. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
